GENOCIDIO Art. 361. del Código Penal de La Republica de El Salvador (Decreto Nº 1030)

CÓDIGO PENAL DE LA REPUBLICA DE EL SALVADOR

TITULO XIX - DELITOS CONTRA LA HUMANIDAD - CAPITULO UNICO

GENOCIDIO Art. 361.- El que con el propósito de destruir parcial o totalmente un determinado grupo humano, por razón de su nacionalidad, raza o religión,

cometiere homicidios u ocasionare daños corporales
o psíquicos a miembros del grupo o los sometiere a condiciones que hicieren difícil su subsistencia
o les impusiere medidas destinadas a impedir su reproducción
o realizare el desplazamiento violento de personas hacia otros grupos,

será sancionado con prisión de diez a veinticinco años.

La sanción podrá aumentarse hasta treinta años si el directamente responsable de cualquier acto de genocidio fuere un funcionario civil o militar.
La proposición y la conspiración para actos de genocidio, serán sancionadas con prisión de seis a doce años; y la incitación pública para cometer genocidio, será sancionada con prisión de cuatro a ocho años.

VIOLACION DE LAS LEYES O COSTUMBRES DE GUERRA Art. 362.- El que durante una guerra internacional o civil, violare las leyes internacionales o costumbres de guerra o de cualquier manera ocasionare daños psíquicos o corporales, deportación para trabajos forzados de la población civil en territorio ocupado, maltrato de prisioneros de guerra, muerte de rehenes, saqueo de la propiedad privada o pública, destrucción innecesaria de ciudades o pueblos o desvastación no justificada por necesidades militares, será sancionado con prisión de cinco a veinte años.

VIOLACION DE LOS DEBERES DE HUMANIDAD - Art. 363.- El civil no sujeto a la jurisdicción militar, que violare los deberes de humanidad con los prisioneros o rehenes de guerra o heridos a consecuencia de la misma, o con los que estuvieren en los hospitales o lugares destinados a heridos y el que cometiere cualquier acto inhumano contra la población civil, antes, durante o después de acciones de guerra, será sancionado con prisión de cinco a veinte años.

DESAPARICION FORZADA DE PERSONAS - Art. 364.- El funcionario o empleado público, agente de autoridad o autoridad pública, que detuviere legal o ilegalmente a una persona y no diere razones sobre su paradero, será sancionado con prisión de cuatro a ocho años e inhabilitación absoluta del cargo o empleo respectivo por el mismo término

DESAPARICION FORZADA COMETIDA POR PARTICULAR - Art. 365.- El que realizare la conducta descrita en el artículo anterior, habiendo recibido órdenes o instrucciones de funcionario o empleado público, agente de autoridad o autoridad pública, será sancionado con prisión de tres a seis años y multa de ciento ochenta a doscientos días multa.

DESAPARICION DE PERSONAS PERMITIDA CULPOSAMENTE - Art. 366.- El que por culpa permitiere que otro cometa el delito de desaparición forzada de personas, será sancionado con pena de dos a cuatro años de prisión, multa de cien a ciento ochenta días multa. Si fuere funcionario o empleado público, agente de autoridad o autoridad pública se le impondrá además, inhabilitación para el ejercicio del cargo o empleo respectivo por igual término.

COMERCIO DE PERSONAS - Art. 367.- El que por sí o como miembro de una organización internacional, se dedicare al comercio de personas con cualquier fin, será sancionado con prisión de cuatro a ocho años.
Si el comercio se realizare con mujeres o niños salvadoreños, la sanción podrá aumentarse hasta en una tercera parte del máximo señalado.

TITULO XX - DELITOS DE CARÁCTER INTERNACIONAL - CAPITULO UNICO

PIRATERIA - Art. 368.- Será sancionado con prisión de cinco a quince años:

1) El que cometiere en alta mar, en el mar adyacente o en la plataforma continental, actos depredatorios o violentos contra una nave o contra personas o cosas que en ella se encontraren;
2) El que se apoderare de alguna nave o de lo que perteneciere a su equipo, carga o equipaje, por medio de fraude o violencia cometida contra su comandante;
3) El que, por cuenta propia o ajena, equipare una nave destinada a la piratería; y,
4) El que con violencia desviare una nave o la hiciere desviar a lugar diferente de su destino.

El que a sabiendas comerciare con piratas o les suministrare auxilio, será considerado como coautor.
Si por los actos de violencia u hostilidad mencionados anteriormente se ocasionare la muerte de alguna persona que se encontrare en la nave atacada o dichos actos tuvieren por objeto exigir rescate, la sanción se aumentará hasta con la mitad del máximo señalado.

PIRATERIA AEREA - Art. 369.- Se aplicará la misma sanción establecida para los casos previstos en los números 2 y 4 del artículo anterior, cuando los hechos se realizaren en aeronaves, ya sea dentro del espacio aéreo nacional o fuera de él.

ORGANIZACIONES INTERNACIONALES DELICTIVAS Art. 370.- Los que dirigieren o formaren parte de organizaciones de carácter internacional, dedicadas a traficar con esclavos, al comercio de personas o realizaren actos de piratería aérea o infringieren disposiciones de los tratados aprobados por El Salvador para proteger los derechos humanos, serán sancionados con prisión de cinco a quince años.

Forced Disappearance Of People Art. 364. - The civil employee or public employee, agent of authority or public authority, who will stop legal or illegally to a person and he will not give reasons on his whereabouts, will be sanctioned with prison of four to eight years and absolute incapacitation of the position or respective use by the same term

Forced Disappearance Committed by an Individual Art. 365. - The one that will make the described conduct in the previous article, having received orders or instructions of civil employee or public employee, agent of authority or public authority, will be sanctioned with prison of three to six years and fines of one hundred eighty two hundred days fines.

Disappearance of People Allowed Guiltily Art. 366. - The one that by fault will allow that another comet the crime of forced disappearance of people, will be sanctioned with pain of two to four years of prison, fines from one hundred one hundred eighty days fines. If he will be civil employee or public employee, agent of authority or public authority will prevail to him in addition, incapacitation for the exercise of the position or respective use the same term.

Commerce of People Art. 367. - The one that by himself or like member of an international organization, it will be dedicated to the commerce of people with any aim, will be sanctioned with prison of four to eight years. If the commerce will be made with women or Salvadoran children, the sanction will be able to be increased until in one third part of the indicated maximum.

TITLE XX CHARACTER CRIMES THE INTERNATIONAL I CAPITULATE UNICO

Piracy Art. 368. - It will be sanctioned with prison of five to fifteen years:

1) The one that will commit on the high seas, in the adjacent sea or the continental platform, depredatorios or violent acts against a ship or people or things that in her will be;
2) The one that will seize of some ship or which will belong to its equipment, loads or luggage, by means of fraud or violence committed against its commander;
3) The one that, by own or other peoplés account, compares a ship destined to the piracy; and,
4) The one that with violence will turn aside a ship or will make it turn aside to place different from its destiny.

The one that knowingly will deal with pirates or will provide aid to them, it will be considered like coauthor.
If by the acts of violence or hostility mentioned previously the death of some person will be caused who will be in the attacked ship or these acts will intend to demand rescue, the sanction will be increased until with half of the indicated maximum.

Aerial Piracy Art. 369. - The same sanction established for the cases anticipated in numbers 2 and 4 will be applied of the previous article, when the facts are made in airships, or within the national airspace or outside him.

International Criminal Organizations Art. 370. - Those that will direct or comprise of organizations of international character, dedicated to deal with slaves, to the commerce of people or will make acts of aerial piracy or will infringe dispositions of treaties approved by El Salvador to protect the human rights, will be sanctioned with prison of five to fifteen years.
